The petitioner apprehends his arrest in a case registered for the offence under Section 304(B)/34 of the Indian Penal Code.

Allegation is that the accused persons including this petitioner caused death daughter of the informant due to nonfulfillment of demand of dowry. Petitioner is brother of husband of the deceased.

It is submitted on behalf of petitioner that allegation is general and omnibus. It is further submitted that after trial, husband of the deceased has already been acquitted by the trial court, vide order dated 03.11.2021 passed in S.T.No. 178 of 2020 (Annexure - 3). Petitioner is separate in mess & property and has got no concern with the alleged crime. Petitioner has got clean antecedent.

No.34478 of 2022(3) dt.01-11-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Govindganj P.S. Case No. 407 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
