Victim has stated in her statement recorded under section 164 of the Cr.P.C that it was the petitioner who forcibly took her and confined in a room at Supaul where she was raped by the petitioner. Victim appears to be minor at the time of alleged occurrence.

Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Nauhatta P.S. Case no. 250/2015 pending in the court of Addl. Sessions Judge I-cum-Special Judge, Saharsa stands rejected. However, trial of the petitioner should be expedited by the concerned court.
