1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Sarairanjan P.S. Case no.175 of 2024 registered under sections 310(2) and 317(3) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the accused persons on a motorcycle and Scorpio vehicle on the point of pistol are said to have stopped the informant who was driving the Bolero pickup vehicle carrying pamphlets from Patna to Madhepura. It is further stated that the accused were aged about 20-25 years and were of average built. The accused dispossessed the informant of the vehicle, assaulted him and escaped. The informant further states that he could not see as to how many

4. Learned counsel for the petitioner submits that the F.I.R was registered against unknown. The material that has transpired in course of investigation has been dealt with in the order of the learned trial Court. On perusal of the order it would transpire that in paragraph no.8 of the case diary the co-accused Mithun Kumar has taken the name of this petitioner to be involved with others in the occurrence. It is submitted that the said Mithun Kumar also took the name of co-accused Santosh Kumar @ Santosh Sahni who has been enlarged on anticipatory bail vide order dated 6.5.2025 passed in Cr. Misc. no. 24486 of 2025. Neither any incriminating article has been recovered from the petitioner's possession nor has he been put on T.I. Parade. The petitioner has no criminal antecedent.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegation in the F.I.R., the material that has transpired in course of investigation as is evident from the order of the learned trial Court together with the grant of bail to the co-accused Santosh Kumar whose name as that of the petitioner also transpired in the confessional statement of co-

No.33374 of 2025(2) dt.04-06-2025 3/3 accused Mithun Kumar, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Sarairanjan P.S. Case no.175 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Samastipur.
