JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Kasma P.S. Case No. 59 of 2020 registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act.

It is alleged that the police had spotted three motorcycles in suspicious circumstances, being driven by the accused persons. On chase, they were apprehended and from the motorcycle, which the petitioner was riding, 20 liters of Mahua wine was recovered. The petitioner is in custody since 03.08.2020.

Patna High Court CR. MISC. No.33213 of 2020(2) dt.18-12-2020 2/2 Considering the quantity of liquor allegedly recovered from the petitioner's possession and the period of petitioner's custody in connection with the present case, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VII-cum-Special Judge, Excise, Aurangabad in Kasma P.S.
