JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 302 and other ancillary sections of the Indian Penal Code. As per the prosecution case, two miscreants riding on motorcycle came to the shop and demanded rangdari and on refusal they fired upon the brother of the informant and fled away. During treatment brother of the informant died. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. During course of investigation the only material that has come against the petitioner is that he was driving the motorcycle and co-accused Vivek was pillion rider who fired upon the deceased. Petitioner has claimed clean antecedent and he is in custody since 02.03.2021. Test Identification Parade has not been

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in Sitamarhi Police Station Case No. 153 of 2021.
