JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 302 and other minor sections of the Indian Penal Code. The trial court has reported that up till now, three prosecution witnesses have already been examined and, accordingly, the trial court has sought eight months' time to conclude the trial of the petitioner.
In view of the aforesaid report as well as grounds mentioned in order dated 14.10.2015 passed in Cr. Misc. No.23464 of 2015, the prayer for bail of the petitioner in connection with Sessions Trial No.470 of 2015 arising out of Riga P.S. Case No.237 of 2013 pending in the court of 3rd Additional
Patna High Court Cr.Misc. No.9512 of 2016 (4) dt.27-07-2016 2/2 District and Sessions Judge, Sitamarhi stands rejected. However, the learned trial court is directed to conclude the trial of the petitioner within the period as fixed by the trial court itself, failing which the petitioner shall be at liberty to renew his prayer for bail before the trial court itself.
