The petitioner seeks bail in Chanpatiya P.S. Case No. 68/2018, instituted for offences under Section(s) 363, 366, 498A, 323, 328/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. Name of this petitioner has come in the statement of victim recorded under Section 164 Cr.P.C, wherein she has stated that she was kidnapped and raped by three persons, namely, Ayub Gaddi (Petitioner), Tabrej and Jaswant @ Purushotam. Co-accused Tabrej and Jaswant @ Purushotam have already been granted bail by a Co-Ordinate Bench of this Court

Patna High Court CR. MISC. No.31699 of 2019(3) dt.15-07-2019 2/2 vide orders dated 29.01.2019 passed in Cr. Misc. No. 70896/2018 and dated 05.02.2019 passed in Cr. Misc. No. 6035/2019.

Learned counsel for informant has opposed the prayer for bail of petitioner.

Petitioner is in custody since 27.03.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Bettiah, West Champaran, in connection with Chanpatiya P.S.
