JUSTICE SATYAVRAT VERMA ORAL ORDER 14-12-2021 Heard Sri Mithlesh Kumar Singh, learned counsel for the petitioner and learned counsel for the State. Petitioner seeks bail in connection with Goh P.S. Case no. 100 of 2021 registered for the offence punishable under sections 302/34 and 120B of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is in custody since 27.5.2021, is person with clean antecedent and charge sheet has been submitted and is young girl of 20 years old. Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the FIR, it would manifest that the informant alleges that her husband was having affair with this petitioner which infuriated FIR named accused who killed her husband. Learned counsel submits that husband of the informant was known to this petitioner and as

Learned counsel further submits that the informant is not an eye-witness to the occurrence and petitioner is young girl who is not alleged to have committed the occurrence but it is alleged that she was in love with the deceased. Learned APP submits that it was because of love affair the family members of this partitioner killed husband of the informant.

Considering the facts that petitioner is in jail custody, is person with clean antecedent, charge sheet has been submitted, is young girl aged about 20 years and it is alleged that she was in love with the deceased as a result of which this occurrence took place, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Daudnagar District Aurangabad in Goh P.S. Case no. 100 of 2021.
