Counsel for the petitioner (opposite party no. 2) in the connected Criminal Misc. No. 4191 of 2023, submits that the husband of the petitioner had filed an application for grant of anticipatory bail in connection with Complaint Case No. 2734 of 2019, instituted for the offence punishable under Sections 498(A), 323, 341 and 504 of the Indian Penal Code, before this Court bearing Criminal Misc. No. 4191 of 2023, which was disposed of by this Court vide order dated 17.05.2023, operative portion whereof is reproduced herein below:-

No.33303 of 2026(2) dt.19-06-2026 2/3 "The learned court below is directed to take a final call with regard to either confirming the provisional bail to be granted to the petitioner or revoking the same, subject to outcome of the mediation proceeding as also considering the case of the petitioner on merits, without being prejudiced by the dismissal of his anticipatory bail petition by the learned court below.

In the meantime, for a period of four weeks from today, no coercive steps shall be taken by the petitioner herein.

The present petition stands disposed of on the aforesaid terms."

The Ld. Counsel for the petitioner seeks cancellation of anticipatory bail granted to the opposite party no. 2 herein on the ground that though maintenance has been awarded by the Ld. Trial Court but the same is not being paid to the petitioner and she has to fend not only for herself but for her two minor children. It is also submitted that the Ld. Trial Court is yet to take a final call, hence at least it be directed to comply the aforesaid order dated 17.05.2023.

Having considered the averments made in the present petition and the submissions advanced by the Ld. Counsel for the petitioner, I deem it fit and proper to direct the Ld. Court of A.C.J.M-1st, Vaishali at Hajipur in connection with Complaint Case No. 2734 of 2019 to comply the said portion of the aforesaid order dated 17.05.2023 passed by this Court, which
