Petitioner is not named in the first information report and for the first time, name of the petitioner surfaced in this case in the confessional statement of co-accused Rohan Kumar which is evident from para 90 of the case diary. Thereafter, petitioner was arrested and he, too, made his confessional statement.

In course of investigation, Investigating officer tried to collect call details of mobile of co-accused Rohan Kumar as well as the petitioner but from perusal of para 111 of the case diary, I find that mobile, which was used by the petitioner, stood in the name of the Bharat Ram and the explanation of the prosecution is that sim had been taken by the petitioner using forged and fabricated documents. Petitioner does not have any criminal antecedent. Accordingly, petitioner is directed to be released on bail on
