Petitioner is accused in connection with Nardiganj P.S. Case No. 121 of 2015 registered under Sections 341/147/148/149/120B of the I.P.C. and sections 25 (1-b)A, 26, 35 of the Arms Act.
The accusation is that the Police on receiving secrete information about the dispute regarding irrigation reached at Village Chhilkapar Ahra, several person started to flee away but one of them was apprehended by the Police, who disclosed his name as Bhola Prasad and one loaded country made pistol and life cartridge was recovered from his possession, who also disclosed the name of 12 persons, including the petitioner.
Patna High Court Cr.Misc. No.9342 of 2016 (2) dt.06-04-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that in fact, it would appear from the F.I.R. that the name of the petitioner has been disclosed by co-accused Bhola Prasad and the petitioner has not been apprehended by the Police on spot. Moreover, petitioner has no criminal antecedent and is in custody since 04.12.2015.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Nawada in connection with Nardiganj P.S. Case No. 121 of 2015 (Rajendra Kumar Mishra, J.) Shail/- U T
