The petitioner seeks bail in a case registered under Sections 379/411 of the Indian Penal Code.

The prosecution case, in short, is that the informant was pick pocketed by the petitioner.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 08-01-2019. Charge sheet in this case has already been submitted. The petitioner has been falsely implicated in the present case. The petitioner has been made accused in the present case due to mistake of fact. Wallet in question has not been recovered from

Patna High Court CR. MISC. No.31903 of 2019(2) dt.14-05-2019 2/2 possession of the petitioner. It has further been submitted that the petitioner may be released after completion of six months in custody.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of six months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Magistrate, Bettiah in connection with Rail Thana Motihari Case No. 02 of 2019.
