2. Heard learned counsel for the petitioners and learned A.P.P. for the State.

3. Petitioners seek regular bail in connection with Sadar (Sonki O.P.) P.S. Case No.16 of 2024 registered under Sections 461 and 379 of the I.P.C.

4. As per prosecution case, the allegation of theft of costly items from the shop of the informant by way of breaking asbestos and damaging the CCTV is against unknown.

5. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this

Patna High Court CR. MISC. No.38717 of 2024(2) dt.26-06-2024 2/2 case on the basis of confessional statement of co-accused Baijnath Kumar Yadav. The F.I.R. has been lodged against unknown. Nothing has been recovered from possession of the petitioners. Except confessional statement, there is no material against the petitioners. The charge sheet has already been submitted. Petitioners have no criminal antecedents and they are in custody since 12.01.2024.

6. Learned A.P.P. opposes the prayer for bail of the petitioners.

7. Having considered the facts and circumstances of the case and submissions of the parties, let the above named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Darbhanga in connection with Sadar (Sonki O.P.) P.S. Case No.16 of 2024.
