The petitioner seeks bail in Bochahan P.S. Case No.38 of 2020, registered under Sections 272, 273 and 120(B) of the Indian Penal Code and under Sections 30(a), 32(ii) and 38(ii) of the Bihar Prohibition and Excise Act.

The informant got information that many persons have brought a truck loaded with liquor and, on such, a raid was conducted and truck bearing registration no.RJ-09GB-5257 was intercepted. 6703 litres of liquor was recovered from the truck. The informant named seven persons in the FIR. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Name of the petitioner

Patna High Court CR. MISC. No.32320 of 2020(2) dt.07-12-2020 2/2 surfaced after five months of the occurrence and that too on the basis of the fact that the petitioner was seen sitting in a Creta vehicle with Sanu Mishra who happens to be the cousin of the petitioner. Nothing has been recovered from the Creta vehicle. The petitioner is in jail since 02.08.2020.

Taking into consideration the facts and nature of allegation made against the petitioner, petitioner, namely, Ravi Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Bochahan P.S. Case No.38 of 2020.
