On account of missing of Ruby Kumari aged about 16 years on 26.09.2014, Sanha was recorded on 27.09.2014. Subsequently thereof, informant's father came to know that she was taken away by Akhilesh Chauhan, Dhirendra Yadav (petitioner) and Rintu Chaudhary over motorcycle. Ruby was taken to the place of father's sister of Dhirendra (petitioner) where Akhilesh had committed rape upon her. However, she had not alleged specifically against the petitioner who happens to be under custody since 18.10.2014.

In the aforesaid facts and circumstances of the case, petitioner, Dhirendra Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like
