JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and co-accused Salu Singh are said to have opened fire on deceased. Para- 50 of the case diary reveals that two firearm injuries were found on the person of the deceased at the time of post mortem examination but the doctor specifically stated in post mortem report that both the firearm injuries found on the person of the deceased were communicating to each other. The submission on behalf of the petitioner is that the aforesaid finding of the doctor goes to show that deceased had sustained only one firearm injury and, therefore, the accusation against the petitioner appears to be doubtful. Considering the aforesaid facts and circumstances and
Patna High Court Cr.Misc. No.16776 of 2015 (4) dt.10-09-2015 2/2 also taking note of this fact that except the present case as well as one another case petitioner does not have any criminal antecedent and investigation has already been completed, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Session Judge III, Khagaria in connection with session trial no. 14 of 2015 arising out of Parbatta P.S.Case No.35 of 2012, G.R.No.972 of 2012.
