2. Earlier the bail application of the petitioner was rejected by this Court on 23.05.2023. The petitioner seeks regular bail in a case registered for the offence under Sections 33, 34, 36 of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, one Gopal Kumar died due to consumption of illicit liquor.
4. By relying on various orders of this Court (as contained in Annexure- 3 series), learned counsel for the petitioner submits that a number of similarly situated co-accused persons have been granted bail by this Court.
5. Considering the grant of bail to the similarly
Patna High Court CR. MISC. No.38532 of 2024(2) dt.12-07-2024 2/2 situated co-accused persons, this application for regular bail is allowed.
6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge- 1st, Nawada/concerned Court below in connection with Nawada (Town) P.S. Case No. 378 of 2021 subject to condition that:- 6(i). The petitioner will mark his attendance at the Nawada Mufassil Police Station on the every Sunday of the month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
7. In view of the above, this application stands allowed.
