The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 379/34 of the Indian Penal Code.

It is alleged that the jewellary and cash were found missing from the almirah of the informant, when suspicion was raised against Sobha Kumari, the daughterin-law of the informant, the petitioner and others who have some relationship with Sobha Kumari.

It is submitted by the learned counsel for the petitioner that accusation has been based on suspicion and the husband of Sobha Kumari is the step-son of the informant. Though, Sobha Kumari has also filed a complaint case against informant though subsequent to

Patna High Court Cr.Misc. No.14721 of 2015 (2) dt.10-04-2015 the filing of the present case by the informant. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Sobha Kumari has been granted bail vide Cr. Misc. No. 4547 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Gaya in connection with Magadh University P.S. Case No. 54 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
