Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 135 of the Indian Electricity Act.

Accusation is of consumption of electricity energy unauthorisedly as loss has been calculated Rs. 2,18,542/-. It is submitted by the learned counsel for the petitioner that petitioner was consuming electricity under the valid connection which approved for running 08 H.P. motor. However, the petitioner is ready to deposit 50% of the alleged due amount within a period of two months.

Considering the present stand of the petitioner, let the above named petitioner be released on provisional

Patna High Court Cr.Misc. No.9308 of 2016 (2) dt.01-03-2016 anticipatory bail for three months on deposit of 50% of the loss amount of Rs. 2,18,542/- in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge(Electricity) Magadh Division Area, Gaya, in connection with Bodh Gaya P.S. Case No. 14 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. The provisional bail of the petitioner will be confirmed by the learned court below on deposit of 50% of the loss amount of Rs. 2,18,542/-.

The above deposit will be subject to assessment or compounding proceeding.
