2. The petitioner seeks bail in connection with Sugauli P.S. Case No. 496 of 2018, dated 12.12.2018, registered for the offence under Sections 341, 323, 324, 307 and 302/34 of the Indian Penal Code.
3. As per the allegation, the petitioner and others surrounded the informant's brother at the door of the co-accused Bhagwan Sahani and started assaulting him. It has been further alleged that upon hearing the noise, when father and mother of the informant came to save the brother of the informant, coaccused Bhagwan Sahani gave gupti blow in the abdomen of the father of the informant, while the petitioner is alleged to have given bamboo blow on the head of the mother of the informant. It has further been alleged that all the accused persons assaulted

No.39207 of 2026(2) dt.17-06-2026 2/3 with lathi and bamboo stick, when villagers came, injured persons were taken to Primary Health Center, from where considering the seriousness of the condition of the father of the informant, he was referred to the higher center at Motihari, but during the course of treatment he died.

Learned counsel appearing for the petitioner has submitted that specific allegation of assault upon the deceased is against co-accused Bhagwan Sahani and although there is allegation against the petitioner of inflicting assault upon the head of the mother of the informant by means of bamboo stick, but the injuries are simple in nature. It has been further submitted that the petitioner is a labourer and he was not aware of the case as he had gone to Gujarat in connection with his livelihood. It has further been submitted that petitioner has voluntarily surrendered before the court below. It has further been submitted that there is a delay of three days in lodging the FIR. It has been further submitted that the petitioner has got no criminal antecedents. It has lastly been submitted that the petitioner is in custody since 30.01.2026, charge-sheet having been filed and there is no allegation of tampering against the petitioner.

6. Heard learned counsel for the parties and perused the records.
7. Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, East Champaran at Motihari, in connection with Sugauli P.S. Case No. 496 of 2018.
