The petitioner seeks bail in Kateya P.S. Case No. 126 of 2012, corresponding to Sessions Trial No. 354 of 2012, registered for the offences punishable under Sections 341, 324 and 307 of the Indian Penal Code.
The prayer for bail of the petitioner was earlier twice rejected by this Court.
Learned counsel for the petitioner submits that the petitioner is rotting in jail for more than two years. Six witnesses have already been examined and only two witnesses including the doctor are yet to be examined.
Having considered the facts that the petitioner is alleged to have repeatedly assaulted the informant with knife in his
Patna High Court Cr.Misc. No.18172 of 2015 (2) dt.15-06-2015 2/2 abdomen, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
The trial court is directed to expedite the trial and conclude the same within four months from the date of receipt/production of a copy of this order, if the trial is not concluded the petitioner may renew his prayer for bail. The Superintendent of Police, Gopalganj is also directed to ensure attendance of the two witnesses in court on the next date fixed for examination of the witnesses. If the Superintendent of Police, Gopalganj does not produce the witnesses the trial court shall report to this Court about nonproduction of the witnesses in court. Let a copy of this order be sent to the court of the learned Additional Sessions Judge 1st, Gopalganj as well as the Superintendent of Police, Gopalganj for needful. (Prabhat Kumar Jha, J.)
