JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 11.06.2014 in a case registered for the offences punishable under section 20, 22, 23, 24 of the N.D.P.S. Act.

From co-accused Deo Narayan Yadav 100 gram of brown sugar was recovered who is said to have received the contraband from one Anil Yadav. On the statement of Deo Narayan Yadav the petitioner and others were apprehended. It is submitted by learned counsel for the petitioner that there is no recovery from the possession of the petitioner. Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.16823 of 2015 (3) dt.22-06-2015 2/2 petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 3rd, East Champaran, Motihari in connection with NDPS case No. 40/2014 arising out of Raxaul P. S. case No. 133 of 2014. Considering the fact that petitioner is accused in another case registered under N.D.P.S. Act, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in serious offence or defaults without any reasonable cause on three consecutive occasions.
