====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-08-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Petitioners seek regular bail in connection with Patepur P. S. Case No. 373 of 2024 in a case registered for the offences punishable under Sections 30(a), 32(2), 41(1) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, total 5220.825 liters illicit liquor was recovered from seized vehicles and these petitioners are alleged to have fled away from the spot.

4. Learned counsel for the petitioners submits that petitioners are neither drivers nor owners of the seized vehicles in question. Name of the petitioners transpired on the basis of

Patna High Court CR. MISC. No.32650 of 2025(3) dt.08-08-2025 2/2 secret information. No incriminating material has been recovered from conscious possession of the petitioners and they are no way connected with the aforesaid recovery. Petitioner no. 1 is in custody since 17.04.2025 and petitioner no. 2 is in custody since 08.04.2025. Charge-sheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of allegation and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2-cum-District and Additional Sessions Judge, Vaishali at Hajipur in connection with Patepur P. S. Case No. 373 of 2024.
