JUSTICE RAJENDRA JKUMAR MISHRA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sabour (Goradih) P.S. Case No. 06 of 2016, registered under Section 401 of the Indian Penal Code.

The accusation is that the Police, in course of patrolling duty to maintain law and order, received secret information about gathering of some miscreants for making the preparation of committing theft. Thereafter, informant reached at Goradih then 2-3 persons started fleeing away after seeing the Police party, but the petitioner was apprehended and on verification, the petitioner was found involved in four other cases.

No.9306 of 2016 (2) dt.05-04-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that admittedly the petitioner is accused in four cases, but he has been acquitted in three cases as detailed in para 3 of the bail petition. The petitioner has falsely been implicated in this case only on suspicion. The petitioner is in custody since 10.01.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Bhagalpur in connection with Sabour (Goradih) P.S. Case No. 06 of 2016. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
