The petitioner seeks bail in Saraiya P.S. Case No. 194 of 2019, instituted for the offence under Section(s) 414, 467, 468, 471, 472, 419, 420, 171, 120(B) of Indian Penal Code and Section 25(1-B)a of the Arms Act.

Supplementary affidavit has been filed on behalf of the petitioner. Let it be kept on the record. It is alleged in the written report that Police recovered four vehicles, one double barrel gun with 19 cartridges and Rs.4,96,490/- from the house of Mithlesh Singh. Petitioner along with other co-accused was apprehended by the Police from the house of Mithlesh Singh.

Patna High Court CR. MISC. No.31740 of 2019(2) dt.13-05-2019 2/2 Counsel for the petitioner submits that recovery of the vehicles and firearm has been made from the campus of coaccused Mithlesh Singh. By filing supplementary affidavit counsel for the petitioner submits that out of four, two vehicles have already been released to the rightful owner. He further submits that seized gun is licensee gun of Subhash Chandra Singh who is also accused in the case.

As per written report and seizure list there is no recovery from conscious possession of the petitioner. Petitioner is in custody since 30.3.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st (West), Muzaffarpur, in connection with Saraiya P.S. Case No. 194 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
