The petitioners seek bail in anticipation of their arrest in connection with Masaurhi P.S. Case No. 365 of 2020 dated 07.06.2020 instituted for the offences under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.

It has been alleged in the FIR that the petitioners and about 5-7 others assaulted the informant by means of lathi. So far as the petitioners are concerned, there is no specific accusation against them. One of the co-accused person of this case viz. Kundan Kumar has also lodged a case against the informant and

Patna High Court CR. MISC. No.194 of 2021(2) dt.26-07-2021 2/2 others vide Masaurhi P.S. Case No. 364 of 2020. There is a counter version of the occurrence and the parties have settled their dispute which fact appears from paragraph-12 of the bail petition.

Regard being had to the aforestated facts, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Masaurhi in connection with Masaurhi P.S. Case No. 365 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
