Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is in custody in connection with Ahiyapur P.S. Case No. 584 of 2015 for the offences instituted under Sections 364(A) and 120(B) of the Indian Penal Code and Section 25(1-B)(a), 26 and 35 of the Arms Act.
As per prosecution case, it is a case of snatching of mobile and also recovery of some arms from the possession of the accused persons.
The earlier bail application of the petitioner was rejected vide order dated 01.12.2015 passed in Cr.Misc.No.45592 of 2015
Patna High Court Cr.Misc. No.11265 of 2016 (3) dt.30-03-2016 with an observation that the same is rejected at this stage. The charge has been framed on 09.02.2016 and the other co-accused persons have been granted bail by this Court vide Cr.Misc.No.5727 of 2016 dated 02.03.2016.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in connection with Ahiyapur P.S. Case No. 584 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Muzaffarpur. (Sudhir Singh, J) B.Kr./- U T
