JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. Petitioner is not named in the first information report and nothing has been recovered from his conscious possession. Petitioner is in jail custody since long but up till now, he has not been put on Test Identification Parade.

The learned Sessions Judge failed to mention this fact as to how the name of petitioner surfaced in this case but learned counsel for the petitioner informs that name of petitioner came in confessional statement of co-accused, Md. Irfan, who has already been granted privilege of bail by a co-ordinate Bench of

Patna High Court Cr.Misc. No.11081 of 2016 (2) dt.10-03-2016 2/2 this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sheohar in connection with Piprahi P.S. Case No. 04 of 2014.
