The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366(A), 34 of the Indian Penal Code and Section 8 of the Protection of Children From Sexual Offences Act.

It is alleged that minor niece of the informant has been abducted by all the F.I.R named accused persons including the petitioner.

It is submitted by learned counsel for the petitioner that the victim in her 164 Cr.P.C statement has recorded her age as 18 years and stated that she of

Patna High Court CR. MISC. No.34882 of 2022(2) dt.29-11-2022 2/2 her own will went along with the petitioner to Punjab and solemnized marriage with him. She desired to live with the petitioner as wife in her matrimonial house. The 164 Cr.P.C statement of the victim is annexed as Annexure-2 to the petition.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District Judge, VI-cumExclusive Special Court (POCSO Act), Munger in connection with Asarganj P.S. Case No. 99 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
