JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 02-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
The petitioner, who was represented under section 317 of the Cr. P.C. on 12.08.2013, could not respond on account of presence of four witnesses whereupon his petition under section 317 of the Cr. P.C. was rejected ultimately, cancelling bail bond as well as issuance of warrant of arrest non bailable. Even thereafter his presence was not secured and any how, he was arrested and remanded on 05.02.2015 in this case.
Accordingly, the petitioner, namely, Yogi Baitha is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with one surety along
Patna High Court Cr.Misc. No.20047 of 2015 (3) dt.02-07-2015 2/2 with cash surety of Rs. 25,000/- to the satisfaction of learned Additional Sessions judge I, East Champaran, Motihari in connection with S. Tr. No. 236 of 1998/ Pipra P.S. case No. 84/1986.
In case there happens to be absence of petitioner then in that event, the aforesaid cash amount will be forfeited otherwise the amount will be returned back to the petitioner after conclusion of trial.
