====================================================== CORAM: HONOURABLE MR. JUSTICE ANSUL ORAL ORDER 20-05-2026 Heard learned counsel for the petitioner and learned APP for the State through video conferencing.

2. The petitioner seeks bail in connection with Sessions Trial No. 463 of 2024 arising out of Sakra P.S. Case No. 158 of 2023 instituted for the offences under Sections 302/34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner was allowed bail vide order dated 31.07.2024 passed in Cr. Misc. No. 38833 of 2024. Thereafter, on 20.09.2025, her bail was cancelled. On 30.03.2026, the petitioner appeared but fled away from the judicial custody. Subsequently, the petitioner

Patna High Court CR. MISC. No.34291 of 2026(2) dt.20-05-2026 2/3 was arrested on 11.04.2026 from her house and thereafter, she was sent under judicial custody on 12.04.2026. Since, then, the petitioner is in judicial custody. Counsel further submits that the petitioner has no criminal antecedent.

4. Learned A.P.P for the State has vehemently opposed the prayer for grant of bail to the petitioner.

5. Considering that the petitioner was represented through her lawyer on 30.03.2026 but she fled away thereafter and the petitioner was earlier allowed bail on merit, therefore, this Court is inclined to grant bail to the petitioner.

6. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of District & Additional Sessions Judge-10, Muzaffarpur, in connection with Sessions Trial No. 463 of 2024 arising out of Sakra P.S. Case No. 158 of 2023, with condition that:- (i) the petitioner must be appearing before the Trial Court on each and every scheduled date.

7. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case
