02-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Bettiah Town (Kalibag) P.S. Case No. 137 of 2021, registered for the offence under Section 413, 414 of the Indian Penal Code and Sections 25(1-B) (a)/26/35 of the Arms Act.

As per the prosecution case, this petitioner was apprehended with a stolen Hero Splendor motorcycle and one Samsung Mobile phone.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner and petitioner has been made accused in this case on the instance of his enemies. The motorcycle in question does not belong to petitioner, rather it was provided by co-accused

Patna High Court CR. MISC. No.44044 of 2021(3) dt.02-11-2021 2/2 Imteyaz and Rohit for their own work and petitioner is simply a victim of false implication. Petitioner has got clean antecedent and he is in custody since 27.02.2021. Chargesheet has been submitted.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Town (Kalibag) P.S. Case No. 137 of 2021.
