This is the third attempt of the petitioner to seek regular bail in connection with Baikunthpur P.S. Case No. 248 of 2018 instituted for the offences under Sections 302 and 34 of the Indian Penal Code.

Earlier his prayer for bail was rejected vide order dated 06.02.2019 in Cr. Misc. No. 253 of 2019 and thereafter again vide order dated 29.06.2020 in Cr. Misc. No. 4073 of 2020. In the order dated 29.06.2020, it was recorded that the trial has completed and only the doctor was to be examined. Learned counsel for the petitioner submits that till date the case has remained as it was on 29.06.2020. The Court for the present is not persuaded to consider

Patna High Court CR. MISC. No.43830 of 2021(2) dt.14-12-2021 2/2 the case of the petitioner for bail, the prayer for bail is thus refused.

However, the learned court below is directed to ensure that the doctor is examined and the case is concluded by 04.03.2022. In the event if the trial is not concluded by 04.03.2022, the petitioner will be at liberty to renew his prayer for bail.
