JUSTICE AMARESH KUMAR LAL ORAL ORDER 10-04-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 25 (1) B/a and 26 of the Arms Act.

The allegation against the petitioner is that on the complaint of father of the petitioner, the police came to his house when the petitioner was trying to escape, he was apprehended and on search of his house, a country made pistol and five live cartridges were recovered.

It is submitted that the nothing has been recovered from the conscious possession of the petitioner. He has no criminal antecedent. However, after investigation, charge sheet has already

Considering the facts and circumstances of the case, let the above-named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Smt. Sulekha Jha, Judicial Magistrate, 1st Class, Munger/court concerned in Dharahra P.S. Case No.189 of 2014 after framing of charge with the following conditions : 1.

One of the bailors will be the close relative of the petitioner.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
