JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-05-2015 Petitioner is languishing in custody since 10.01.2015 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
On commission of dacoity in the house of the informant the First Information Report was registered against unknown. The name of the petitioner subsequently sprang up during investigation on confession of co-accused when it was alleged that petitioner was the driver of the alleged vehicle through which the miscreants travelled to the place of the occurrence. Moreover one robbed mobile was recovered from the petitioner.
It is submitted by learned counsel for the petitioner that seized mobile is registered in the name of the mother of the petitioner and it is not the same mobile which was robbed. Moreover the recovered mobile has not been put on test identification parade. The petitioner has also not been
Patna High Court Cr.Misc. No.16928 of 2015 (2) dt.14-05-2015 2/2 put on test identification parade. A statement to that effect has been made in para 14 of the petition.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Nanpur P.S. Case No. 12 of 2015.
