2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 30 litres of illicit codeine cough syrup has been recovered from the basement of a restaurant.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. Nothing incriminating has been recovered from the conscious possession of the petitioner. The alleged basement of the restaurant in question from where the recovery has been made

Patna High Court CR. MISC. No.34337 of 2025(2) dt.03-07-2025 2/2 was under construction and as such, it was an open place accessible to one and all. Petitioner has no concern with the alleged recovery.

5. Learned APP for the State has opposed the bail petition and submits that petitioner is the owner of the basement of the restaurant in question from where the recovery has been made.

6. Considering the fact that 30 litres of illicit codeine cough syrup has been recovered from the base of the restaurant in question and petitioner is the owner of the said restaurant in question, the prayer for anticipatory bail of petitioner is rejected.
