The petitioner is accused in connection with Bhagwanpur P.S. Case No. 33 of 2015 registered under Section 364/34 of the Indian Penal Code.
The accusation is of kidnapping of son of informant by six persons named in the F.I.R. including the petitioner on 14.06.2014.
Learned counsel for the petitioner submits that while the occurrence took place on 14.06.2014 but the written report, which is the basis of F.I.R., submitted before the police on 03.03.2015 after nine months. It is further submitted that petitioner has no criminal antecedent and is in custody since
Patna High Court Cr.Misc. No.196 of 2017 (2) dt.12-01-2017 01.07.2016. It is further submitted that similarly situated coaccused, Arun Yadav, has already been granted privilege of bail by this Court vide order dated 27.09.2016 passed in Criminal Misc. No. 40335 of 2016.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Bhagwanpur P.S. Case No. 33 of 2015. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
