Petitioner seeks bail in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act. Petitioner is husband of opposite party no. 2. Allegation is of demand of dowry and torture for the same. Petitioner is ready for restoration of relationship with opposite party no. 2.
Considering the submission of the petitioner, let the petitioner, above named, be released on provisional bail for six months from the date of release on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court CR. MISC. No.32312 of 2019(2) dt.15-05-2019 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Complaint Case No. 200 of 2017, with the following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. In the meantime, petitioner shall take appropriate step for conciliation with the opposite party no. 2 and restoration of relationship. The court below shall also take initiative for settlement of the matrimonial dispute, thereafter, the court below shall confirm the bail bond of the petitioner.
