Petitioner has inter alia prayed for following reliefs in the paragraphs No.1 of the writ petition:- "That this application is being filed on behalf of petitioner for issuance of an appropriate Writ/Writs/directions to the Respondents for making appointment of the petitioner on the compassionate ground as the petitioner is the only son of the deceased employee and there is no source of income for the survival of the family of the deceased employee."

Learned counsel appearing on behalf of the petitioner submitted that case of the petitioner is that father of the petitioner had died in harness while he was posted as Assistant Teacher, Upgraded Middle School, Jokhari but respondents authorities are not taking any action in respect of his appointment on compassionate ground.

Learned counsel appearing on behalf of the State has submitted that in paragraph no.11 of the counter affidavit filed on behalf of the respondent no.5, it has been stated that petitioner's application for compassionate appointment is at serial no. 68 in the list and now only 38 posts are available for compassionate appointment in the district of Bhojpur. The case of the petitioner can be considered in future, if such posts become available or any new guidelines is issued.

5. Considering the aforesaid information, petitioner, if so desire, may make his application, as and when such vacancy arises.
