The petitioners are languishing in custody since 11.08.2014 in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. It is alleged that the brother of the informant Madhusudan Yadav went to the company of co-accused Kaushal Yadav and Sughar Yadav on 18.06.2014 but he did not return. Subsequently, his dead body was recovered from the well of Sughar Yadav with hands and legs tied. The petitioner no. 1 was named in the FIR whereas the name of petitioner no. 2 sprang up subsequently. During investigation it was found that the victim

It is submitted by learned counsel for the petitioners that considering the suspicious nature of accusation five co-accused persons have been granted bail vide Cr. Misc. No. 1770 of 2015. The investigation has already concluded. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Narayanpur P.S. Case No. 43 of 2014.
