Petitioner seeks bail in a case registered under section 302/34 of the Indian Penal Code.

Petitioner and two other FIR named accused as well as some unknown persons are said to have brutally assaulted the deceased with fists and slaps. The deceased was suffering from kidney disease at the time of alleged occurrence and post mortem report shows that deceased died due to injuries caused on his abdomen. Moreover, having more or less similar allegation coaccused Riyaju Alam and Wahid Alam have already been granted privilege of bail and, therefore, to maintain the parity of justice, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram in Dehri P.S.
