JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 05-09-2023 Heard Dr. Anjani Prasad Singh, learned counsel appearing on behalf of the petitioner; Mr. Manish Kumar, learned counsel for the Employees Provident Fund Office; Mr. Vikash Kumar, learned counsel for the Biscomaun and Mr. Sushil Kumar, learned GP 22 for the State.

2. Learned counsel appearing on behalf of the petitioner submits that the petitioner is entitled for payment of EPF amount due to him, which has not been paid to the petitioner due to incorrect Employee's Code (Member I.D. Code).

3. Considering the limited prayer made on behalf of the petitioner, the Regional Provident Fund Commissioner, Patna is directed to call for the records relating to the petitioner and make

Patna High Court CWJC No.9748 of 2023 dt.05-09-2023 2/2 necessary correction in the Employee's Code (Member I.D. Code) forthwith. In case, the Regional Provident Fund Commissioner, Patna finds it proper to get certain relevant records from the Managing Director, Biscomaun, the same may be provided to him within a period of one week. The Managing Director, Biscomaun must also ensure to send the records relating to the EPF as well as Employee's Code (Member I.D.Code) to the Regional Provident Fund Commissioner, Patna within the aforesaid period. The petitioner, if so advised, may also approach the concerned authority for redressal of his grievance in accordance with the provisions of Employees Provident Fund and Miscellaneous Provisions Act, 1952. So far as the other consequential reliefs are concerned, the Managing Director, Biscomaun may consider the case of the petitioner in the light of order passed by the Hon'ble Apex Court as per the seriatum.

4. With the above observation/direction, the present writ petition is disposed of.
