JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-04-2015 Petitioner is languishing in custody since 20.12.2014 in a case registered for the offences punishable under Sections 147, 148, 307, 323, 324, 342, 379 of the I.P.C. It is alleged that accused persons started construction unauthorizedly on the land of the informant and when the protest being made co-accused Suman Patel assaulted sister-in-law of the informant namely Ramawati Devi and co-accused Nawal Patel and Bharat Patel assaulted Umesh Patel. It is also alleged that this petitioner and Ramesh Patel assaulted the elder brother of the informant Saheb Patel. Other family members of the informant were also assaulted. It is submitted by learned counsel for the petitioner that accusation has been levelled in the background of the land dispute when the injury of Saheb Patel alleged to have been caused by this petitioner and Ramesh Patel has been

Patna High Court Cr.Misc. No.13899 of 2015 (2) dt.10-04-2015 2/2 found to be simple in nature. Moreover there is counter version of the occurrence also and co-accused has been granted bail vide Cr. Misc. No. 4300 of 2015.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Raxaul at Motihari in connection with Darpa P.S. Case No. 59 of 2014, G.R. No. 499 of 2014.
