NILU AGRAWAL ORAL ORDER 26-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is languishing in jail custody since 30.1.2015 in connection with Shankarpur P.S.Case No.19/15 (G.R.No.154/2015) for the offence under Section 379 and 411 of the I.P.C.
The prosecution case, in brief, is that in the evening of 28.1.2015 at 5 P.M. the informant after parking his Activa motor cycle at his door entered the house. After some time he heard the sound of his motorcycle in running condition. When he came out of his house he saw that one Ranjeet Kumar son of Late Bacho Yadav was fleeing away with his motorcycle. It has been submitted by the Learned counsel for the
Patna High Court Cr.Misc. No.16967 of 2015 (6) dt.26-08-2015 2/2 petitioner that the petitioner has no criminal antecedent and he has falsely been implicated in this case. He has further submitted that the petitioner being agnate and having some important work had taken motorcycle without information of the informant and the motorcycle having been recovered, does not amount to any offence which finds place in the case diary.
Under such circumstance, let the petitioner, Ranjeet Kumar, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction A.C.J.M., Madhepura, in Shankarpur P.S.Case No.19/15. (Nilu Agrawal, J) AnilKrSinha/- U T
