====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 13-05-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Bhagwanpur Hat P.S. Case No. 113 of 2018, instituted for the offence under Section(s) 341, 323, 307, 379 and 504/34 of Indian Penal Code. Counsel for the petitioner submits that there is case and counter case between the parties on account of land dispute. Counter case vide Bhagwanpur P.S. Case No. 115 of 2018 has been lodged against the informant and others by Gyanti Devi, in which, petitioner had also sustained injury. The injury report of the petitioner has been enclosed as Annexure-3. In the instant case it is alleged that petitioner along with Gyanti Devi assaulted son of the informant namely, Ravi Prakash. Petitioner is in custody since 11.3.2019 having

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Siwan, in connection with Bhagwanpur Hat P.S. Case No. 113 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
