The petitioner is in custody in connection with Nautan P.S. Case No. 315 of 2014 registered for the offence under sections 376 and 493/34 of the Indian Penal Code. Referring to the F.I.R., learned counsel for the petitioner submits that no case under section 376 of the Indian Penal Code is made out against the petitioner. He contends that the main allegation is against accused Lal Babu Paswan. He submits that the F.I.R. has been instituted maliciously for oblique purpose.
Considering the nature and the manner of
Patna High Court Cr.Misc. No.8365 of 2015 (2) dt.10-04-2015 occurrence as alleged, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Nautan P.S.
