====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-08-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Cheriya Bariyarpur P. S. Case No. 41 of 2023 in a case registered for the offences punishable under Sections 188, 290 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

3. As per the prosecution case, 15 liter county made liquor has been recovered from the field of co-accused Pradip Kumar. Petitioner is alleged to be involved in manufacturing of the said liquor.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious

Patna High Court CR. MISC. No.38075 of 2024(2) dt.09-08-2024 2/2 possession of the petitioner and he is no way connected with the aforesaid recovery. For the present case, petitioner is in custody since 30.04.2024. Charge-sheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioner has got six criminal antecedents out of which five cases are of similar nature.

6. Considering the period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Judge-1st, Begusarai in connection with Cheriya Bariyarpur P. S. Case No. 41 of 2023 corresponding to S.T. No. 150 of 2022/CIS No. 150 of 2022. (Prabhat Kumar Singh, J) Navya/- U T
