The petitioners seek bail in connection with Chandramandih P.S. Case No. 75 of 2014 registered under Sections 342, 323, 307 and 504/34 of the I.P.C. The accusation is that the petitioners, being the brother-in-law of the informant Khelu Yadav, went at his house where due to dispute in between the informant and his wife, they poured kerosene oil and lit the fire, in which the informant sustained injury.
Learned counsel appearing on behalf of the petitioners submits that it would appear from the F.I.R. itself that
Patna High Court Cr.Misc. No.7667 of 2015 (3) dt.10-04-2015 2/2 the occurrence is said to be in the house of the village of the informant and the petitioners have not been apprehended from there. In fact, there is dispute in between the sister of the petitioners and informant due to that reason, he tried to commit suicide and in that course, he sustained injury but due to ulterior motive, the informant figured the name of the petitioners. It is also submitted that the burn injury, as found on the person of informant, is about 48 per cent and not on the vital part of the body. The petitioners are in custody since 11.11.2014. Having regard to the facts and the circumstances of the case, the petitioners, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class, Jamui in connection with Chandramandih P.S. Case No. 75 of 2014.
