The petitioner apprehends his arrest in Banmankhi P.S. Case No.125 of 2020, registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The informant after having received the information about selling of liquor in Banmankhi cattle fair raided the place, but none was apprehended. Liquor was recovered from the place and the people disclosed that Rajesh Das, Pradeep Gupta, the petitioner, and Bablu Paswan were selling liquor. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and this is the first case in which the petitioner has been made accused. Taking into consideration the facts that nothing has been recovered from possession of the petitioner and the petitioner has got no criminal antecedent, petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Purnia in connection with Banmankhi P.S. Case No.125 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
