Petitioner seeks bail in a case registered under Sections-302, 307, 328 & other minor sections of the Indian Penal Code and 27 of the Arms Act.
Taking into consideration that the alleged occurrence took place in the year, 1996 and petitioner could be remanded in this case on 22-12-2015 and, furthermore, charge sheet against him was submitted much prior, showing him absconder, I am not inclined to release the petitioner on bail at least, at present and accordingly, his prayer for bail in connection with Palasi P.S. Case No. 139 of 1996 pending in the court of
Patna High Court Cr.Misc. No.12064 of 2016 (2) dt.17-03-2016 2/2 learned Chief Judicial Magistrate, Araria stands rejected. Learned Chief Judicial Magistrate, Araria should commit the case of the petitioner to the court of sessions in accordance with law as early as possible and after that, the concerned Sessions court should expedite the trial of the petitioner.
